Email marketing: consent, unsubscribe and deliverability

Technical deliverability and lawful permission to send are two different questions.

Reviewed on 2026-11-08

Lawful basis and specific rules

GDPR governs personal-data processing. Marketing email also requires assessment under ePrivacy and the implementing national rules; in Belgium, check consent, exceptions and the right to object.

Permission and preferences

Record contact origin, communication choices, preference changes and opt-outs. Do not import purchased lists without a verified lawful basis.

Separate marketing from transactional

Order confirmations and newsletters serve different purposes. Separate sending domains and providers can help manage reputation and incidents.

Measure without overcollecting

Use meaningful bounce, complaint and conversion indicators with appropriate retention, transparency and local tracking-law assessment.
